Recently, Tian Yuan and a German cooperative law firm jointly represented a leading Chinese manufacturing company and won an appeal at the German Federal Supreme Court (BGH). The case lasted for five years, and after going through arbitration by the China International Economic and Trade Arbitration Commission, a preliminary hearing at the Cologne Regional High Court in Germany, and an appeal hearing at the German Federal Supreme Court, it finally made decisive progress.
Tian Yuan team worked closely with the cooperating law firm and based on the reasonable application of the United Nations Convention on Contracts for the International Sale of Goods and the New York Convention rules, it fully demonstrated the legitimacy of the arbitration procedure to the German court, pointed out the factual and procedural flaws in the defense of the party applying for enforcement, and obtained the Full support from the German Federal Supreme Court.
